The Company offers the “WeerWi” Application to users in strict compliance with Senegalese law 2008-12 of 25 January 2008 relating to the protection of personal data and the General Data Protection Regulation (RGPD), which regulates the processing of personal data on the territory of the European Union. The user’s personal data collected by the editor through the use of the Application are subject to be processed electronically to ensure the availability of the Application and/or the relevance of the Services and Content.

Any regulatory developments in terms of the protection of personal data that may result in stricter obligations apply directly and automatically to the processing of personal data of users of the Application.

Terms relating to the protection of personal data that are not defined in this present Privacy Policy are defined in the General Terms and Conditions of use of the application WeerWi.

Data collection and protection

Your data is collected by the company ApiAfrique.

The data controller/ responsible for processing is ApiAfrique and can be contacted by email at contact@weerwi.com.

Personal data means any information relating to an identified or identifiable physical person directly or indirectly, by reference to an identification number or one or more elements, specific to his physical, physiological, genetic identity, psychiatric, cultural, social, or economic.

This Privacy Policy explains how the WeerWi Application collects, receives, uses, stores, shares, transfers and processes User Personal Data.

It also details the options and rights the user has regarding his Personal Data, including his rights of consultation and modification.

Personal information that can be collected on the Application is mainly used by the editor for the management of relations with you, and if necessary for the processing of contact requests.

The information given by the user

Our App has access to your data when you register and download our App.

When the user registers on the Application, the Company collects information such as her name, address, phone number and email address, country, region, date of birth, date of last menstrual period, duration of menstrual cycle, and the length of her period.

Purpose of the use of data

The purpose of the personal data collected from users is to provide the services of the Weerwi Application, improve them and maintain a secure environment. The legal basis of the processing is the execution of the contract between the user and the Company through the use of the Application. Specifically, the uses are:

• access and use of the Application by the user;
• operation management and optimization of the Application;
• implementation of user support;
• verification, identification, and authentification of the data transmitted by the user;
• fraud prevention and detection, malware (malicious software or malware) and security incident management;
• managing any disputes with users.

We may use the information you provide to us to contact you from time to time to provide you with important information, updates or promotions.

Collect accurate data on the real-time location of the device

The Application in its first version does not collect precise data on the geographical location of the device.

Third-party access to data obtained through the platform

Only aggregated, anonymous data is periodically transmitted to external services to help us improve the Application and our services. We will only disclose your information to third parties by the means described in this Privacy Policy.

We may disclose data provided by the user, and information collected automatically:

• as required by law, in order to comply with a subpoena, or other legal process;
• when we believe in good faith that the disclosure of your information is necessary to protect your rights, your security or those of other users, during a fraud investigation, or to respond to a government request;
• with our trusted partners, who work on our behalf, who do not have an independent use of this data, and who have agreed to adhere to the rules of this privacy policy;
• when authorized by the user;
• if the WeerWi Application is in the process of acquisition, or sale of some or all of its features, you will be notified by email and/or by an important article on our site about any change of ownership or use of this information whatever it is.

The user will have the choice regarding this information to be transferred by unsubscribing and requesting the deletion of your personal data.

If, when consulting the Application, you access personal data, you must refrain from any collection, unauthorized use and any act that may constitute an invasion of privacy or reputation of individuals.

The editor declines all responsibility in this regard.

Unsubscription

You can easily stop any information collection by the Application by uninstalling it. You can use the standard uninstall process from your phone or from the PlayStore or Appstore, or your computer.

Data storage and security

Various security technologies and procedures are used to protect the User’s Personal Data from unauthorised access, use or disclosure. The Personal Data provided by the User is stored in Belgium.

We are concerned about safeguarding the confidentiality of your information. We provide and maintain by all physical, electronic and legal means the protection of this information. For example, we restrict access to this information to authorised personnel who need this information to develop or improve the Application. Please note, however, that despite all our efforts to provide reasonable security for this data, no system can prevent possible breaches in security.

Data retention policy

Data is conserved and used for a period of time in accordance with current legislation.

To the extent reasonably necessary or required to satisfy legal or regulatory obligations, settle disputes, prevent fraud and abuse or enforce our terms and conditions, we may also retain some of your information as necessary, even after you have closed your account or we no longer need it to provide our services to you.

We will keep User Information for as long as you use the Application. We will hold the information collected for the duration of your use of the Application and may subsequently delete, anonymise or otherwise archive it.

Right of access, rectification and deletion of your data

In compliance with the regulations applicable to personal data, users have the following rights:

• right of access: they may exercise their right of access to their personal data by writing to the e-mail address given below. In this case, before exercising this right, the Platform may request proof of the user’s identity in order to verify its accuracy; request that information be updated;
• the right to delete data: users may request the deletion of their personal data, in accordance with applicable data protection laws;
• the right to restrict processing: users may ask the platform to restrict the processing of personal data in accordance with the assumptions set out in the RGPD;
• the right to object to the processing of data: users may object to their data being processed in accordance with law no. 2008-12 of 25 January 2008 on the protection of personal data and in the cases provided for by the RGPD.

All requests must be accompanied by a photocopy of a valid, signed identity document and state the address at which the publisher may contact the applicant. A reply will be sent within one month after receipt of the request. This one-month period may be extended by two months if the complexity of the request and/or the number of requests so require.

In addition, and since the law n°2016-1321 of 7 October 2016, people who so wish, have the possibility of organising the outcome of their data after their death.

Children

We do not use the application to solicit data from children under the age of 13. If the parent (legal guardian) realises that their child has provided us with data without their consent, they can contact us at contact@weerwi.com and we will delete this data within a reasonable period of time.

Cookies

Cookies A “cookie” is an electronic file placed on a terminal (computer, tablet, smartphone, etc.) and read, for example, when a website is consulted, an e-mail is read, software or a mobile application is installed or used, regardless of the type of terminal used (source: https://www.cnil.fr/fr/cookiestraceurs-que-dit-la-loi ).

The application may automatically collect standard information. Any information collected indirectly will only be used to monitor the volume, type and pattern of traffic using the service, to develop its design and layout and for other administrative and planning purposes and generally to improve the service we offer you.

Where applicable, “cookies” issued by the application publisher and/or third-party companies may be placed on your terminal with your consent. Before continuing navigation, the customer and/or prospect must accept or refuse the use of cookies. The consent given will be valid for a period indicated in the message. Users may deactivate cookies at any time.

Photographs and representation of products

The photographs accompanying the descriptions are not contractual and are not binding on the publisher.

Prohibition on selling of personal data

The Company commits to never selling a user’s personal data to third parties.

Applicable law

These conditions of use of the Application are governed by Senegalese law and by the RGPD and are subject to the jurisdiction of the Senegalese courts.

Changes

This Privacy Policy may change from time to time for various reasons. We will notify you of any such changes by posting the new Privacy Policy on https://www.weerwi.com/politique-de-confidentialite/ and by notifying you via the Application. You are advised to consult this Privacy Policy regularly, as continued use signifies agreement to any changes.

Your consent

By using the Application, you consent to the processing of your data by the company, as explained in this Privacy Policy. Processing means the use of ‘cookies’ on computers, including the ability to collect, store, delete, combine and disclose data, all of which activities are permitted in Senegal. If you reside outside Senegal, your data will be transferred, processed and stored in accordance with Senegalese confidentiality standards.
